The Wage and Hour Division is conducting free compliance assistance events focused on raising awareness and compliance with federal labor laws. This initiative by the Wage and Hour Division of the U.S. Department of Labor is part of a larger effort to connect employers in the home health care industry with the information they need to better understand their responsibilities and obligations under the law.

9:00am-10:30am WHD | FLSA and Home Health Care industry-Employment Relationship

Information given at this session will help you determine how to comply with the Fair Labor Standards Act minimum wage and overtime provisions of the Homecare Final Rule. This session will also discuss how misclassification of workers as independent contractors can unwittingly cause employers to violate a wide range of labor laws, including the labor standards provisions of the DBA or SCA, the Fair Labor Standards Act, and even the Family Medical Leave Act.  This module will discuss how the employment relationship is defined and determined under these labor laws and assist employers to evaluate their own workforce for signs of misclassification.


10:30am-11:15am WHD | The Family & Medical Leave Act  

The FMLA presentation summarizes key FMLA provisions and focuses on the areas of most significance, including employer coverage and employee eligibility requirements, serious health conditions, intermittent leave usage, employer and employee notice requirements, and the medical certification process. 

11:15am-12:00pm WHD | Investigative Procedures and Common Violations

 During this session attendees will learn more about the Wage and Hour Division, its enforcement of federal labor laws, and common violations to avoid!

Effective January 1, 2015, direct care workers employed by agencies and other third-party employers are entitled to receive at least the federal minimum wage and overtime pay.

Direct care workers are workers who provide home care services, such as certified nursing assistants, home health aides, personal care aides, caregivers, and companions.
